Beat the Mobile Phone Ban

Use of Mobile Phones Banned While Driving

As of Sunday 1 November 2009, the Land Transport (Road User) Amendment Rule 2009 (referred to as “the ban”) was brought into force throughout New Zealand.

 

How Will This Affect You?

Aside from improving the safety of our roads, the regulation effectively bans the use of mobile phones while driving a vehicle, with the following activities being EXPRESSLY prohibited:

  • Making, receiving, or ending a voice call;
  • Creating, sending, or reading a text message;
  • The use of a mobile phone in “any other way”. This includes playing music, checking calendar appointments, etc...

The penalty for breaching the ban is an $80.00 fine, plus the loss of 20 demerit points.

A proviso has been included in the ban as a realistic compromise for the large number of business and individuals who rely on having non-interrupted access to mobile communication, and for situations where the in vehicle use of a mobile phone may otherwise be necessary.

 

Clause 7.3A, subclause 5(a) states that:

“A driver may, while driving a vehicle, use a mobile phone to make, receive, or terminate a telephone call if—

  • “(a) the phone is secured in a mounting fixed to the vehicle; and
  • “(b) the driver manipulates the phone infrequently and briefly.”
